The Enduring Power of Attorney form is a legal document that allows you (the principal) to appoint one or more people (your attorneys) to make financial and legal decisions on your behalf. Unlike a General Power of Attorney, this authority continues even if you lose mental capacity, ensuring your affairs can still be managed. Attorneys may operate bank accounts, buy or sell property, or manage investments but cannot make health or lifestyle decisions. The form must be signed by you and witnessed by a prescribed professional (such as a solicitor, barrister, licensed conveyancer, or NSW Trustee employee). Attorneys must also sign to accept their responsibilities, which include acting in your best interest, keeping records, and separating their own assets from yours.
