Form AS1 is the HM Land Registry deed used by personal representatives, the executors or administrators of a deceased person's estate, to formally agree that the whole of a registered property passes to the person entitled to it, known as the beneficiary or transferee. Once executed and registered, the beneficiary becomes the new registered proprietor. An assent isn't a sale: the property passes by inheritance rather than through a purchase.
You need the grant of representation confirming your authority to deal with the estate: a grant of probate if the deceased left a valid will naming executors, or letters of administration if they didn't. HM Land Registry won't process an AS1 without this evidence. You'll also need the property's title number and the exact details of the deceased proprietor and the personal representatives, matching the register and the grant precisely, since mismatches are the most common cause of a delay.
The title number and property address, the date of the assent, the deceased proprietor's name, the personal representatives making the assent, and the transferee receiving the property. If more than one person is taking the property, the form records how they'll hold it, as joint tenants or as tenants in common, and HM Land Registry will enter a Form A restriction on the register unless the details show they're holding it as joint tenants for themselves alone. The transferor must execute the deed, witnessed by an independent adult.
AS1 doesn't register itself. It's submitted together with a completed AP1 application and the grant of probate or letters of administration, plus identity evidence if no conveyancer is involved. Because an assent involves no purchase price, the HM Land Registry fee is calculated under Scale 2 based on the property's value. Most assents are exempt from Stamp Duty Land Tax since no consideration changes hands, though a Stamp Duty Land Tax return may still be needed if the beneficiary takes on a mortgage or pays something toward the property.
