Form CH1 is a legal charge, the document that secures a loan against a property in England and Wales. The borrower charges the property to the lender by way of legal mortgage, and the lender is then entered in the register as the owner of the charge. It is the form a lender or its conveyancer uses when a mortgage is taken out on a property.
The form is split into numbered panels. You give the title number and property address, the date, the borrower and the lender (including company numbers where relevant), and the lender's address for service. You then state whether the borrower charges with full or limited title guarantee, whether the lender is under an obligation to make further advances, and any additional provisions, such as the sums to be paid.
The borrower must execute the charge as a deed in panel 10. A deed usually means the signer's signature is witnessed, with the witness adding their name and address. Forms of execution are set out in Schedule 9 to the Land Registration Rules 2003. If an obligation to make further advances has been applied for in panel 8, the document must also be signed by the lender or its conveyancer.
The form states that it should be accompanied by either Form AP1 or Form FR1. Documents sent to HM Land Registry are generally open to public inspection, and the form warns that dishonestly entering untrue or misleading information can amount to fraud, so complete it with care.
