Form IHT402, Claim to transfer unused nil rate band, is a schedule that goes with Form IHT400. It lets the personal representatives of someone who died on or after 9 October 2007 claim the Inheritance Tax nil rate band their late spouse or civil partner did not use, which can increase the amount that passes free of tax.
Fill it in if the deceased died on or after 9 October 2007, their spouse or civil partner died before them, that spouse's or partner's estate did not use up all of the nil rate band available to it, and you want to transfer the unused amount to the deceased's estate.
You need details of the first spouse or civil partner, such as their name, date of death, address and date and place of marriage or civil partnership, and information about who inherited from their estate and any gifts made in the seven years before death. The executor or administrator of that estate can often help. Send photocopies of the grant of representation, or the death certificate if there was no grant, any will, and any deed of variation.
The form must reach HMRC no later than 24 months after the end of the month in which the deceased died. For example, if the deceased died on 10 October 2007, the deadline would be 31 October 2009. For help, visit www.gov.uk/inheritance-tax or call the Inheritance Tax helpline on 0300 123 1072.
