Form TP1 is the HM Land Registry deed used to transfer part of a registered freehold or leasehold title in England and Wales, while the transferor retains the remainder. It's the counterpart to Form TR1, which transfers the whole of a title. TP1 is used whenever land is being divided — selling off part of a garden for a new build, splitting a large plot between family members, transferring a parcel to a neighbour, or a developer selling individual plots carved out of a larger site.
Because only part of the registered title is changing hands, HM Land Registry needs to know exactly which portion is transferring and what happens to the boundary between the retained and transferred land. The transferred parcel becomes a brand new title with its own title number, while the transferor's existing title is updated to show the reduced extent of land they retain. This division often requires the parties to agree new rights and obligations between the two parcels — rights of way, shared drainage or services, boundary maintenance responsibilities, and restrictive covenants governing use of the transferred land.
A plan clearly identifying the boundaries of the land being transferred is required — typically a scaled plan referencing Ordnance Survey mapping, prepared by a surveyor or the conveyancer, showing the transferred parcel edged in a distinct colour. TP1 must also be submitted alongside an application form: Form AP1 for an existing registered title, or Form FR1 if the transfer is part of a first registration. The transferor's title deeds, evidence of any mortgage discharge on the transferred portion, and confirmation of Stamp Duty Land Tax (via Form SDLT1) typically accompany the submission.
The transferor signs TP1 as a deed, with their signature witnessed by an independent adult. The transferee signs only where TP1 includes a declaration or covenant requiring their signature — such as accepting new restrictive covenants or agreeing to maintain a shared boundary feature. Once executed, the conveyancer submits TP1 with the accompanying plan and AP1/FR1 application to HM Land Registry, usually electronically through the Land Registry Portal or Business Gateway. HM Land Registry then creates the new title for the transferred land and updates the original title to reflect the reduced extent.
