What is a Non-Durable Power of Attorney?

A non-durable power of attorney is a legal document in which one person (the principal) grants another person (the agent, sometimes called an attorney-in-fact) authority to act on their behalf in financial and property matters. Unlike a durable power of attorney, the authority is not durable - it ends if the principal becomes incapacitated and unable to manage their own affairs.

The principal decides how broad the authority is. It can cover some or all subject areas - banking, real estate, taxes, investments. It does not cover health-care decisions, which are handled through a separate medical or health-care directive. The authority takes effect immediately upon signing and continues until the principal becomes incapacitated, dies, revokes it, a stated ending event occurs, or the agent resigns or becomes unable to act.

When People Use It

A non-durable power of attorney comes up in a range of situations, including:

• Periods of absence, such as military deployment or extended travel, when someone needs another person to handle property or accounts for a defined time.
• A specific transaction or limited project, such as closing a real estate sale or managing an account while the principal is temporarily unavailable.
• Convenience arrangements, where a principal who remains fully capable wants help with day-to-day matters like paying bills or handling banking.
• Situations where the principal specifically does not want the authority to survive incapacity, preferring it to lapse automatically rather than continue.

Why People Use It

• A defined endpoint at incapacity. The authority stops automatically if the principal can no longer manage their affairs, which some principals prefer over authority that continues through incapacity.
• Control over who acts and how. The principal chooses the agent, defines the scope, and can attach special instructions.
• Convenience without a durability commitment. It allows another person to handle financial and property matters while the principal is available and capable, without extending into a period of incapacity.
• Immediate effect. The authority takes effect as soon as the document is signed.
